General Terms and Conditions for Using the Click And Fit Platform

1. Subject of the Terms

These Terms define the rules for access to and use of the Platform, including making activity bookings and regulating the interaction between users and instructors.

2. Registration and User Account

To make a booking, you may be required to create a user account. During registration, you agree to provide true, accurate, current, and complete information about yourself, as requested in the registration form.

You are responsible for maintaining the confidentiality of your account credentials and agree to accept responsibility for all activities carried out through your account.

3. Personal Data

In order to complete a booking and provide you with access to the Platform, we collect and process personal data. The Company acts as the data controller in relation to the collected information.

The Platform collects the following personal data from users: name, phone number, and email address. Additional data that is not mandatory for using the Platform but may improve the user experience (such as date of birth or gender) may also be collected with your consent. The data is processed in accordance with our Privacy Policy. The data is processed on the legal basis of performance of a contract (the booking).

Your data will be provided to the relevant instructor (the owner of the activity) solely for the purpose of contacting you in case of cancellation, change, or other information related to your booking. The instructor also acts as an independent data controller with respect to the data received from us for the purposes of your reservation.

We will not provide your data to other third parties.

Instructors using the Platform provide company details, including company name, UIC, and address, which do not constitute personal data under the GDPR.

Users' personal data is stored on servers located within the European Union, ensuring an adequate level of protection under the GDPR.

4. Payments

Payments for bookings or subscriptions are processed entirely by the external payment service provider Stripe.

The Platform does not collect or store any bank card data, including card number, CVV code, or expiration date. All transactions are securely processed through Stripe's system.

We store only transaction-related information: whether the payment was successful, the amount, the time, and the subject of the payment.

5. Liability

The Platform acts as an intermediary between users and instructors. We are not responsible for the quality, safety, or content of the activities offered by the instructors.

Instructors are solely responsible for the services they provide.

You agree to release, indemnify, and hold harmless the Company, its employees, and representatives from any claims, damages, liabilities, or expenses arising out of your use of the Platform.

6. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and database compilations, is the property of the Company and is protected by Bulgarian and international copyright law.

7. Changes to the Terms

The Company reserves the right to amend these Terms at any time. Changes take effect immediately upon publication on the Platform. Your continued use of the Platform after such publication constitutes your acceptance of the updated Terms.

8. Applicable Law

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. All disputes arising out of or in connection with these Terms shall be resolved by the competent Bulgarian courts.
